Arbitration is one of the most common types of dispute resolution methods used in the construction industry to resolve disputes with a degree of finality, and arbitration clauses are embedded in practically all standard forms of building and engineering contracts in some shape or form. Yet, as important as they are, dispute resolution provisions are often the least looked-at among other commercial terms during the contract negotiation stage. This seminar will explore what constitutes valid arbitration agreements and more generally the legal and practical aspects of drafting multi-tiered dispute resolution provisions that are commonly seen in building and engineering contracts.

Speaker

Mr. Jason Leung - Partner, Mayer Brown Jason is a partner in the Hong Kong office of Mayer Brown. He focuses on construction-related legal proceedings, including litigation and arbitration arising from domestic and international construction projects. He has experience in legal matters relating to the construction engineering and real estate development industry in Hong Kong, Mainland China and overseas. Jason advises clients on legal issues at different stages of a project cycle, including preparation and negotiation of development agreements, construction contracts and construction professional consultancy agreements, public and private tendering and procurement exercise, project management practices, claims preparation and challenge, termination of contracts, final account disputes, defects, delay and enforcement of warranties.
